CONTRACT OFFER AND PRIVACY POLICY

1. General Provisions

1.1. This offer is the official offer of Oleksandr Serazhym (hereinafter referred to as the “Seller”) to enter into the distance Sale and Purchase Agreement for the products via the Seller’s online store https://serazhym.art/ (hereinafter referred to as the “Online Store”).

1.2. This Agreement is a public offer agreement (as defined by Articles 633, 641 of the Civil Code of Ukraine), the terms of which are equal for all Buyers.

1.3. The moment of full and unconditional acceptance by the Buyer of the Seller’s offer (i.e. acceptance) to enter into the electronic Sale and Purchase Agreement shall be the fact of payment by the Buyer for the order under the terms and prices specified in the Online Store.

1.4. Seller: Individual entrepreneur Serazhym Oleksandr Serhiyovych (identification code 3095312391), acting in accordance with the legislation of Ukraine.
Location: Ukraine, Kyiv, Zakrevskogo street, 27/2, apartment 252.

2. Terms and Definitions

  • Product – items listed on the Online Store website.

  • Online Store – a means of selling a product through an electronic transaction.

  • Seller – an entity that sells products presented on the Online Store website.

  • Buyer – an individual (18+) or a legal entity/individual entrepreneur who places orders and purchases products for non-commercial purposes.

  • Order – the Buyer’s completed and placed request addressed to the Online Store to purchase and deliver Products on its behalf.

3. Subject of the Agreement

3.1. The Seller undertakes to transfer the Product to the Buyer, and the Buyer undertakes to pay for and accept the Product under the terms hereof.
This Agreement regulates the purchase and sale of products in the Online Store, including:

  • the Buyer’s voluntary choice of products;

  • the Buyer’s independent registration of the order;

  • the Buyer’s payment for the order;

  • processing and delivery of the order into the Buyer’s ownership.

4. Ordering Procedure

4.1. The Buyer can view the Website content, place orders and use its other services.
4.2. The Buyer is entitled to place an order for any available product.
4.3. Each product is available for ordering in any quantity.
4.4. If a product is unavailable, the manager shall inform the Buyer (by phone or e-mail).
4.5. The Buyer may replace the product, refuse it or cancel the order.
4.6. The Buyer must provide true and complete information. The Online Store shall not be responsible for inaccuracies in the Buyer’s data.
4.7. The Online Store may refuse service if there are grounds to believe that the Buyer provided false information or acts unfairly.

5. Order Payment Procedure

5.1. Payment is made via the Fondy payment server in the national currency of the payer.
5.2. The Buyer shall pay 100% of the Product cost upon placing the Order. If payment is not received, the Seller may cancel the order.
5.3. Delivery costs are paid by the Buyer upon receipt from the carrier.

6. Order Delivery Terms

6.1. Products are delivered via carrier services at their applicable tariffs.
6.2. The Seller confirms dispatch by email and aims to ship:

  • prints — within 48 hours after order confirmation.

6.3. International Delivery:

  • Delivery is available to countries listed on the website.

  • Import duties and taxes may apply upon arrival at the destination country.

  • The Seller is not responsible for such charges.

  • The Buyer is responsible for paying any import duties or taxes.

7. Rights and Obligations of the Parties

Seller’s rights:

  • Unilaterally terminate services if the Buyer breaches the Agreement.

  • Require the Buyer’s compliance with all terms.

Seller’s obligations:

  • Deliver the Product as per the Buyer’s Order.

  • Verify product quality and completeness during packaging.

Buyer’s obligations:

  • Study product information before ordering.

  • Accept or refuse the Agreement terms before purchase.

  • Pay for the order in full and on time.

  • Inspect the Product upon delivery and report any damages immediately.

Buyer’s rights:

  • Order products via the Online Store.

  • Require compliance with the Agreement’s terms.

8. Responsibility of the Parties

8.1. The Parties are liable under the applicable law of Ukraine.
8.2. The Seller is not responsible for:

  • slight color discrepancies due to monitor rendering;

  • inaccurate Buyer information;

  • delays caused by third parties;

  • unlawful actions of the Buyer online.

8.3. In case of Force Majeure, both Parties are exempt from obligations during such events.

9. Product Return Procedure

9.1. Returns are regulated by Ukrainian law.
9.2. The Buyer covers return shipping costs.
9.3. Products may be exchanged or returned within 14 days of purchase, provided they are unused, in original packaging, and accompanied by proof of purchase.
9.4. Upon return, the Seller refunds the amount minus delivery costs.
9.5. Under Decree No. 172 (March 19, 1994), printed products of good quality are not subject to return or exchange.
9.6. Defective printed materials (e.g. misprints, missing pages) will be replaced or refunded.

10. Rules for Using Website Materials

10.1. The Website contains materials protected by Ukrainian law.
10.2. The Buyer may not modify, distribute, or sell website content without permission.

11. Miscellaneous

11.1. The Online Store may amend this Agreement, publishing updates at https://serazhym.art/.
11.2. Use of the website implies consent to the Privacy Policy.
11.3. Disputes are to be resolved through negotiation; otherwise — in Ukrainian courts.
